Ticketchest.com Terms and Conditions

TICKETCHEST.COM IS A PRIVATE LICENSED TICKET BROKER AND IS NOT AFFILIATED WITH ANY PERFORMER, SPORTS TEAM, VENUE, BOX OFFICE, TICKETMASTER.COM, TICKETS.COM OR ANY OF THEIR AFFILIATES.  TICKETCHEST.COM DOES NOT SELL TICKETS FOR FACE VALUE.  WE SELL TICKETS TO SOLD OUT EVENTS AND HARD TO GET PREMIUM SEATS, AND THE PRICE OF OUR TICKETS REPRESENTS THE MARKET VALUE FOR THE SEATS AND THE COST FOR OBTAINING THESE TICKETS.

General.  The following are the rules or terms (the "Terms") that govern use of the Ticketchest.com web site (the "Site") by you, the user of the Site ("Customer").  When using or visiting the Site, Customer expressly agrees to be bound by the Terms and to follow the Terms and all applicable laws and regulations governing the Site. Ticketchest.com reserves the right to change the Terms at any time, effective immediately upon posting to the Site.  If Customer violates the Terms, Ticketchest.com may terminate Customer's access to the Site, bar Customer from future use of the Site, and/or cancel Customer's ticket order.

Orders.  All sales are final.  Tickets are sold for more than face value.  Since tickets are a one-of-a-kind item and not replaceable, there are no refunds, exchanges or cancellations.  If an event is postponed, tickets will be honored for the rescheduled date.  In most instances, new tickets will not need to be issued in order to gain access to the rescheduled date unless otherwise advised by Ticketchest.com.  If an event is cancelled without a rescheduled date, Customer will need to contact Ticketchest.com for a refund.  Ticketchest.com will require the Customer to return the supplied tickets at Customer's expense before receiving any refund that Customer may be entitled to due to cancellation.  Any shipping and service fees are not refundable.  Customer should return the tickets using a traceable delivery method (for example, FEDEX, UPS, USPS guaranteed delivery) and should make a request for refund in writing within 10 business days of the date that it is known that an event has been canceled with no rescheduled date.  Ticketchest.com will not issue exchanges or refunds after a purchase has been made.  We take great pride in our customer service and will always do our best to accommodate you.  Unfortunately, because we are not the box office or venue, it is not possible for us to reissue lost, stolen, damaged or destroyed tickets.  When Customer receives tickets, Customer should keep them in a safe place. Please note that direct sunlight or heat may damage tickets.

Because we sell tickets from various ticket sources, we cannot always list our ticket inventory in real-time.  We do our best to maintain the most accurate ticket inventory possible and constantly update the Site with current ticket availability to make it as accurate as possible.  However ticket prices and availability vary and are subject to constant change.  This is especially true in the days or even weeks preceding a major national event, such as the Super Bowl or the World Series.  The same tickets can drop or increase dramatically in price within hours.  As a result, from time to time, tickets ordered may no longer be available at the price or in the quantity originally ordered at the time the order is received.  If equivalent or better seat locations are available at the same price, and Customer has chosen to be automatically upgraded, Ticketchest.com will fill the order with the alternative seat locations.  If Customer is automatically upgraded, Customer's credit card will be charged at the time the order is received and Ticketchest.com will contact Customer with an email or phone notification of the new seat locations.  If Customer has not chosen to be automatically upgraded, a representative from Ticketchest.com may contact Customer by phone or email to discuss alternative seat locations, and Customer's credit card will not be charged until we have received permission from Customer to fill your order with alternative seat locations.

We accept VISA, MasterCard, American Express, Discover, Pay Pal and Diners Club. Your billing address will be verified with your credit card company; therefore, you must provide us with the exact billing address to which your credit card statements are sent.  In order to protect our Customers from fraud, a Customer may be required to provide additional proof of identify on any order.  Proof of identity may include but is not limited to a signed credit card authorization and/or photocopies of the Customer’s state driver's license or federal passport and photocopies of the Customer’s credit card used to place the order.

By entering your credit card information and submitting an order through our Site, you understand and acknowledge that taking this action constitutes an authorized approval to charge your credit card and shall serve as an authorized signature to do so. 

All orders are shipped via Customer's chosen shipping method to the billing address of Customer's credit card.  When placing an order through our Site, we encourage you to select a delivery method that allows enough time for you to receive your order before the event occurs.  Most orders are processed the same business day in which they are received.  Orders placed after 5:00PM CST Monday through Friday may be processed on the next business day.  Orders placed on a Saturday or Sunday will be processed on the next business day.  For certain events, tickets may not be available for immediate shipment and those ticket listings are typically marked with an estimated shipping date.  In other instances, Ticketchest.com will contact Customer with notification of an approximate shipping date. Tickets will be shipped when available, and choice of an expedited delivery method does not guarantee that tickets will be shipped immediately.  All shipments will require a signature at the point of delivery.  If you have not received your tickets within 48 hours prior to the date of the event, you have an obligation to notify Ticketchest.com via email at orders(at)ticketchest.com or via phone at 888-266-8499.  Currently, our FEDEX domestic shipping rates (within the United States only) are as follows:

FEDEX Express Saver 3-day delivery $10.00
FEDEX 2-day delivery $15.00
FEDEX Standard Overnight delivery $20.00
FEDEX Priority Overnight delivery $25.00
FEDEX Priority Saturday Delivery $30.00
Hawaii and Alaska: TBD

Customers outside of the United States must choose an International delivery option.  If any other option is chosen for an order outside the United States, the shipping cost may be adjusted by Ticketchest.com after the order is placed to apply the appropriate International delivery rate.

If Customer specifies a shipping address that does not allow for delivery verification (such as a Post Office Box), Customer will be required to provide a physical street address for delivery or pay an additional fee to cover the additional risks associated with this type of order.  If such a shipping address is used, Ticketchest.com may, at its discretion, either contact you about the additional fee prior to shipping or cancel your order and notify you of such cancellation.
Delivery of Tickets.  All times for delivery are dependent on the availability in your delivery area.  Once Customer signs for a package delivered by FedEx or other expedited courier service (as the case may be), Customer has 48 hours to contact Ticketchest.com about any mistakes, discrepancies or questions about the tickets and/or seating locations.   If the tickets delivered to you are, in fact, incorrect, Ticketchest.com will attempt to rectify the situation in a timely fashion.  However, if the tickets you originally ordered are no longer available, and equivalent or better replacement tickets are also not available, Ticketchest.com will cancel your order and refund the total amount charged to your credit card account.  In order for Ticketchest.com to process the refund, Customer shall be required to ship the tickets back to Ticketchest.com using a traceable delivery method (for example, FEDEX, UPS, USPS guaranteed delivery) in order to receive the refund.  As stated above, there are no cancellations, refunds or exchanges when the tickets delivered are the tickets ordered by the Customer. 
Due to time constraints involved, Ticketchest.com has satisfied its contractual obligations when the order has been shipped to the address provided by the Customer.  In no event whatsoever shall Ticketchest.com be responsible for any typos or incorrect addresses provided by the Customer to Ticketchest.com or for returned orders when the Customer was not available to sign for the package at the time of delivery at the discretion of FedEx.  In most circumstances, Ticketchest.com will retain packages returned by FedEx for later re-delivery to the Customer at our discretion. Ticketchest.com is not responsible under any circumstances for delivery problems or delays after the order has been shipped.  Customer has an obligation to notify Ticketchest.com of any changes to Customer’s shipping address prior to the order being shipped.  If a shipment needs to be redirected while it is in transit for delivery, Customer is responsible for any additional charges that may apply in order to correct the shipping address problem.  

Initial Order Notification.  Customer’s receipt of an electronic order confirmation via email does not signify Ticketchest.com’s acceptance of your order.  It reflects Ticketchest.com’s acknowledgement of your request for tickets.  Ticketchest.com reserves the right at any time after the receipt of your order to accept or decline your order for any reason.  

Pricing.  Tickets sold through our site are being sold on the secondary ticket market and are being resold in many cases above the "face value" or price listed on the ticket.  Ticketchest.com is not directly affiliated with any performer, sports team, or venue and we do not act as a primary sale box office.  Despite Ticketchest.com’s best efforts, a small number of the items listed on the Site may be mispriced.  If Ticketchest.com discovers that a ticket is priced higher than the stated price on the Site, Ticketchest.com will, at its discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Prices stated on the Site do not include any state or other local taxes that may apply to Customer's order.  We collect tax as required by law.  Generally any event that takes place within the Chicago city limits requires that we collect an amusement tax that is variable up to 8% applied to the difference between the retail value and the face value of the ticket.   

All prices are in United States Dollars (USD) unless otherwise specifically stated.

Permitted Use.  Customer agrees that Customer is only authorized to visit and view this Site for Customer's own personal use, and that Customer shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for Customer's personal use, unless otherwise specifically authorized by Ticketchest.com to do so.  The content and software on this Site is the property of Ticketchest.com and/or its suppliers and is protected by U.S. and international copyright laws.

Links.  The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web.  Ticketchest.com has no control over these sites or the content within them.  Ticketchest.com cannot guarantee, represent or warrant that the content contained in third party sites is accurate, legal and/or inoffensive.  Ticketchest.com does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact Customer's computer systems.  By using the Site to search for or link to another site, Customer agrees and understands that Customer may not make any claim against Ticketchest.com for any damages or losses, whatsoever, resulting from use of the Site to obtain search results or to link to another site.
Typographical Errors.   In the event a ticket or other product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, Ticketchest.com shall have the right to refuse or cancel any orders placed for such ticket or product which is listed incorrectly.  Ticketchest.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and/or your credit card has been charged.  If your credit card has already been charged for the purchase and your order is canceled, Ticketchest.com shall promptly issue a credit to your credit card account in the amount of the charge.
Violation of the Terms.  Ticketchest.com, in its sole discretion, and without prior notice, may terminate Customer's access to the Site, cancel Customer's ticket order or exercise any other remedy available to it.  Ticketchest.com may release Customer information if required by law or subpoena, or if the information is necessary to address any unlawful or harmful activity committed by Customer.

Copyright Policy.  All text, graphics, files, applets, scripts, software and other works on the Site are the copyrighted works of Ticketchest.com. All Rights Reserved.  Any unauthorized redistribution or reproduction of any copyrighted materials on the Site is strictly prohibited.  Ticket Chest, Ticketchest.com and www.Ticketchest.com are protected marks of The Ticket Chest Corporation.

Ticketchest.com reserves the right to terminate the privileges of any Customer who uses this Site to unlawfully transmit or receive copyrighted material without a license or express consent, valid defense or fair use exemption to do so.  We may, in our sole discretion, decide to terminate a Customer's rights to use or access to the Site prior to that time if we believe that the alleged infringement has occurred.

Disclaimers / Limitation on Liability.  TICKETCHEST.COM MAKES NO ASSURANCES THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR PROVIDE SPECIFIC RESULTS FROM USE OF THE SITE OR ANY SITE CONTENT, SEARCH OR LINK THEREIN.  THE SITE AND SITE CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.  TICKETCHEST.COM MAKES NO ASSURANCES THAT FILES CUSTOMER ACCESSES OR DOWNLOADS FROM THE SITE OR ANY THIRD PARTY WEB SITE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES.  TICKETCHEST.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ALSO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  TICKETCHEST.COM WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, LOSS OF BUSINESS OR LOSS OF PROFITS OR CONSEQUENTIAL DAMAGES, WHETHER BASED UPON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

TICKETCHEST.COM DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTY USERS, TICKETCHEST.COM USERS OR CUSTOMERS, ADVERTISERS AND/OR SPONSORS ON THE SITE, IN CONNECTION WITH THE SERVICE OF TICKETCHEST.COM OR OTHERWISE RELATED TO YOUR USE OF THE SITE AND/OR THE SERVICE OF TICKETCHEST.COM.  TICKETCHEST.COM IS NOT RESPONSIBLE FOR THE PRODUCTS, SERVICES, ACTIONS OR FAILURE TO ACT OF ANY TICKET BROKER, VENUE, PERFORMER, PROMOTER OR OTHER THIRD PARTY IN CONNECTION WITH OR REFERENCED ON THE SITE.

Disputes.  If there is any dispute about or involving the Site, Customer acknowledges and agrees that the dispute will be governed by the laws of the State of Illinois without regard to its conflict of law provisions.  Customer agrees to personal jurisdiction in the state and federal courts of Cook County, State of Illinois.

Indemnity.  Customer agrees to indemnify and hold Ticketchest.com, its affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Customer's use of the Site, including also Customer's use of the Site to provide a link to another site or to upload content or other information to the Site.

Registration.  Certain areas of the Site are provided solely to registered Customers of the Site.  Any Customer registering for such access agrees to provide true and accurate information during the registration process.  Ticketchest.com reserves the right to terminate the access of Customers should Ticketchest.com know, or have reasonable grounds to suspect that a Customer has entered false of misleading information during the registration process.  ALL REGISTERED CUSTOMERS MUST BE OVER EIGHTEEN (18) YEARS OF AGE.  Children under the age of eighteen (18) years of age shall not be permitted to register.  Ticketchest.com reserves the right to require valid credit card information as proof of legal age.  Ticketchest.com maintains a strict online Privacy Policy and will not sell or provide Customer credit card information to third parties.

Customer Account.  Customer will select a username and password as part of the registration process.  All Customer account pages are protected with Secure Socket Layer (SSL) encryption.  Customer is fully responsible for maintaining the confidentiality of his or her username and password.  Customer agrees to immediately notify Ticketchest.com at orders(at)ticketchest.com should Customer know, or have reasonable grounds to suspect, that his or her username or password have been compromised.  Ticketchest.com shall not be responsible for Customer's failure to abide by this paragraph.  Ticketchest.com may, in its sole discretion, terminate any Customer's account for any reason.  Under no circumstances shall Ticketchest.com be liable to any Customer or third party for termination of a Customer's account.

Third Party Advertisers.  Ticketchest.com may allow third party advertisers to advertise on the Site.  Ticketchest.com undertakes no responsibility for Customer's dealings with, or any on-line or other purchases from, any third party advertisers.  Ticketchest.com shall not be responsible for any loss or damage incurred by Customer in its dealings with third party advertisers.

Ticketchest.com's Commitment to Online Security.  Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of personal information. [Ticketchest.com encrypts billing information] and all Ticketchest.com employees and agents with access to personal information obtained on the Ticketchest.com web site are also bound to adhere to this policy.  To protect the security of information supplied by customers and businesses on the Ticketchest.com web site, such customers and businesses are provided the opportunity to select user names and passwords to access their information at a future time. 
Personal Information that Ticketchest.com May Collect Online.  Ticketchest.com collects personal information online, including names, postal and e-mail addresses, phone and facsimile numbers, and billing information.  Ticketchest.com does not knowingly collect or maintain any personal information from children under the age of 13. In addition, no part of our web site is designed with the purpose of attracting any person under age 13. 
How Ticketchest.com Uses Personal Information Collected Online.  Unless you otherwise consent, we will use your personal information only for the purpose for which it is submitted, such as to reply to your emails, process ticket orders and respond to billing or shipping inquiries.  At certain points where personal information is collected on our site, there may be a box where you may indicate you would like to be on a mailing list to receive information about Ticketchest.com services.  At any time you can add or remove your name from a CBBB list by contacting us at privacy(at)ticketchest.com.  
How Your Information May Be Shared.  We never sell or rent your personal information. 
Ticketchest.com may also release personal information under the following circumstances: 
•    Where release is required by law (for example, a subpoena) or regulation or is requested by a government agency; 
•    Where our records indicate that a customer or business may be engaged in fraudulent activity or other deceptive practices that a governmental agency should be made aware of; 
•    To appropriate governmental authorities, where warranted by a customer’s or business’ failure to respond to an online privacy complaint; or 
•    To appropriate persons, where your communication suggests possible harm to others. 
Help Us Keep Your Personal Information Accurate.  If your personal information changes or you would like to review the personal information we may have on file, please e-mail us with the new information or your review request at privacy(at)ticketchest.com or call us toll-free at 888-266-8499.
Computer Tracking and Cookies.  The Ticketchest.com site is not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information. 
The Ticketchest.com site may also recognize the online site where a visitor "clicked” in order to gain access to the Ticketchest.com site, but we cannot identify the visitor or the visitor's address. Site information is used for internal marketing and advertising purposes only and may be used to advise other partners and businesses of the numbers of visitors who come to our site from their sites. No personal information is collected.
